Please read these Terms of Service (“Terms”) carefully before using the website at https://ondushvac.com(the “Site”) operated by Ondus Heating & Air Conditioning(“we,” “us,” or “our”). By accessing or using the Site, or by scheduling any service with us, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site or our services.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and Ondus Heating & Air Conditioning. We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the “Last updated” date above. Your continued use of the Site or our services after any changes constitutes your acceptance of the revised Terms.

2. Use of the Site

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

3. Services and Estimates

Ondus Heating & Air Conditioning provides heating, ventilation, and air conditioning (HVAC) installation, repair, maintenance, and related services to residential and commercial customers in Southern New Hampshire.

Any estimate or quote provided by Ondus Heating & Air Conditioning — whether verbal, written, or submitted via the Site — is based on information available at the time of the estimate. Final pricing may vary if the scope of work changes, if unforeseen conditions are discovered upon inspection, or if additional parts or labor are required. A written estimate will be provided and agreed upon before any significant work begins.

Estimates are valid for 30 days from the date of issuance unless otherwise stated in writing.

4. Scheduling and Cancellations

Service appointments are scheduled at mutually agreed times. We ask that you provide at least 24 hours’ notice if you need to reschedule or cancel an appointment. Failure to provide adequate notice or to be present at the scheduled time may result in a service call fee.

We will make reasonable efforts to arrive within the agreed service window. Delays caused by traffic, weather, or unforeseen circumstances at prior jobs may occur, and we will notify you as promptly as possible in such situations.

5. Payment Terms

Payment is due upon completion of services unless otherwise agreed in a written contract. We accept cash, check, and major credit cards. For larger projects, we may require a deposit prior to scheduling and/or ordering equipment; any deposit requirements will be clearly stated in your written estimate.

Invoices not paid within 30 days of the due date may be subject to a late charge of 1.5% per month (18% per annum) on the unpaid balance, or the maximum rate permitted by applicable New Hampshire law, whichever is less. You agree to reimburse us for all reasonable costs of collection, including attorneys’ fees, in the event legal action is required to collect any outstanding balance.

6. Warranty and Workmanship

Ondus Heating & Air Conditioningwarrants that all labor performed will be free from defects in workmanship for a period of one (1) year from the date of service completion, under normal use and conditions. Equipment and parts are subject to the manufacturer’s warranty; we will assist you in processing valid manufacturer warranty claims.

This warranty does not cover damage caused by misuse, neglect, unauthorized modifications, acts of nature, power surges, or failure to perform recommended maintenance.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Ondus Heating & Air Conditioning and its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or our services, including but not limited to loss of revenue, loss of data, or loss of business opportunity, even if we have been advised of the possibility of such damages.

In no event shall our total liability to you for all claims arising out of or related to these Terms or our services exceed the total amount paid by you to Ondus Heating & Air Conditioning in the twelve (12) months preceding the claim.

8. Intellectual Property

All content on this Site — including text, graphics, logos, images, and software — is the property of Ondus Heating & Air Conditioning or its content suppliers and is protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any Site content without our prior written consent.

9. Disclaimer of Warranties

The Site and its content are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. These Terms shall be governed by and construed in accordance with the laws of the State of New Hampshire, without regard to its conflict of law provisions. Any dispute arising under or relating to these Terms or our services shall be resolved exclusively in the state or federal courts located in Hillsborough County, New Hampshire, and you hereby consent to the personal jurisdiction of such courts.

11. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
